GENERAL TERMS AND CONDITIONS OF SALE www.taokids.com, MyTAO Application

CLAUSE 1 - SCOPE

These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded between:

2. Any person wishing to purchase the Products offered for sale by TAO on its website www.taokids.com or its MyTAO application for the purchase of new products (hereinafter referred to as the “Customer”).

The Customer, prior to his/her order, declares that:

  • the purchase of Products on the www.taokids.com website or via the MyTAO application (hereinafter the “Website”) is not directly related to their professional activity and is strictly limited for their personal use only;
  • they have full legal capacity, enabling them to agree to these General Terms and Conditions of Sale.


These terms and conditions apply to the exclusion of all other terms and conditions, in particular those applicable to sales in stores or through other distribution and marketing channels.

These General Terms and Conditions of Sale are accessible at any time on the Website and shall prevail, where applicable, over any other version or any other contradictory document. Unless proven otherwise, the data recorded by TAO constitutes proof of all transactions. The Products presented on the Website are offered for sale worldwide. Product offers are limited to available stocks. Information on the availability of the Products is provided at the time of order preparation. Amendments to these General Terms and Conditions of Sale shall be binding on users of the Website as from their publication online and may not apply to transactions entered into previously. The fact that a natural person (or legal entity) places an order on the Website implies full and complete acceptance of these General Terms and Conditions of Sale, which is expressly acknowledged by the Customer, who waives in particular the right to rely on any contradictory document, which would be unenforceable against TAO.

CLAUSE 2 - ORDERS

The Customer is responsible for selecting the Products they wish to order on the Website, in accordance with the following terms: The Customer selects the desired Products, adds them to their basket and makes payment by means of various validation and acceptance screens. The order will not be definitively saved until final validation of the order payment screen. The sale will only be final, however, once TAO has sent the Customer an email confirming acceptance of the order and receipt by TAO of the full price.

CLAUSE 3 - PRICES

The Products are supplied at the prices in force appearing on the Website when TAO registers the order. Prices are expressed in euros including VAT. Prices take into account the VAT applicable on the day of the order. Should the rate change, such changes may be passed on in the price of the Products without the Customer being informed in advance.
These prices are firm and non-revisable during their validity period. They do not include delivery costs, which are invoiced in addition, under the conditions indicated on the Website and calculated prior to placing the order. The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.

CLAUSE 4 - TERMS OF PAYMENT

4.1 Payment terms

The price is payable in cash online when the order is placed. TAO is not required to deliver the Products ordered by the Customer if the latter does not pay the price in full under the terms and conditions indicated below.

  • Payment by Paypal:
    Paypal payments are debited at the time of order payment validation.
  • Payment by bank card:
    Bank card payments are debited at the time of order payment validation.
  • TAO gift card payment (old and new generation)
    The gift card number must be entered by the customer at the time of payment in the case of online payment. The gift card must be presented in person when paying in-store.
  • Payment by Shopping Pass gift voucher
    Gift voucher payments are only available for Shopping Pass vouchers, and only in-store. Shopping Pass vouchers are not accepted as online payment. No other gift voucher format will be accepted as a means of payment.

It is expressly stipulated that bank cheques are a form of payment refused within the TAO network (in-store and online).

In the event of non-compliance with the payment terms set out above, TAO reserves the right to suspend or cancel delivery of the Customer’s orders in progress.

4.2 Specific features relating to the gift card

4.2.1: Purchasing the Gift Card (new generation – from 14/04/2022)

The Gift Card is sold exclusively in Tape à l'Œil shops. There are no authorised resellers or Internet sales. Any purchase of a Gift Card other than in a Tape à l'Œil shop is fraudulent, of which the client is informed.

The client acknowledges that in the event of purchasing a Gift Card other than in a Tape à l'Œil shop, he/she alone will be liable for the consequences of the fraud. Tape à l'Œil will in no way be held responsible and the company will not owe the client anything.

The price of the Gift Card can be paid in cash or by credit card. Gift Cards can be credited with an amount of between €10 and €250 at the time of purchase.

The Gift Card cannot be reimbursed after purchase. The initial credit or available credit cannot be exchanged for cash or reimbursed by any means whatsoever.

4.2.2: Use of the gift card

Any purchase or use of the Gift Card implies full and complete acceptance by the purchaser and user of these general terms and conditions, which are available and can be consulted in TAPE A L'OEIL shops, on the back of the Gift Card and on the www.taokids.com website.

Validity

The Gift Card is only valid for the purchase of products in TAPE A L'OEIL stores located in France and on our website at www.taokids.com .

The Gift Card is valid for one year from the date of purchase. Its expiry date is indicated on the Gift Card activation ticket and can be obtained on request at the checkout or from customer service. The customer can also consult the balance and history of purchases made on the www.taokids.com website. This validity period cannot be extended. After the expiry date, the card can no longer be used to purchase TAPE A L'OEIL products and the unused balance cannot be claimed.

Terms of use

The Gift Card allows its beneficiary to make purchases for an initial and maximum amount of 10 to 250 euros (according to the prepaid amount indicated on the Gift Card activation ticket and can be communicated to the cardholder on request at the checkout or to customer service using the number on the back of the card).

The Gift Card can be used in one or more transactions until the amount on the card is used up.

If the price of the products purchased with the Gift Card is less than the initial value, this price is deducted from the initial amount, with the available balance corresponding to the difference between the previous balance and the amount of the purchase. The remaining balance of the Gift Card is shown on the "TPE" ticket given at the time of purchase. This balance can also be communicated to the cardholder on request at the cash desk.

If the price of the products purchased with the Gift Card is higher than the initial balance or, if applicable, the available balance, the difference may be paid in cash or by any other means of payment accepted by TAPE A L'OEIL shops.

Once the validity date has expired, or the balance has been used up, the Gift Card can be destroyed. However, if you have paid for a purchase on the www.taokids.com website, and you need to be reimbursed, you are strongly advised to keep the Gift Card as it will automatically be re-credited to the payment method used at the time of purchase.

4.2.3: Liability

The Gift Card is not nominative and the responsibility for its use rests exclusively with its bearer.

TAPE A L'OEIL cannot be held responsible for the loss, damage or theft of the Gift Card. TAPE A L'OEIL will not replace or reimburse the Gift Card.

The Gift Card is sold for personal and non-professional use. Any act of resale of the Gift Card is strictly prohibited and may be the subject of a complaint for fraud on the part of Tape à l'Œil.

Similarly, the Gift Card code is personal. In the event of disclosure of the code, the client alone assumes responsibility for the resulting faults and damages.

4.2.4: Claims and disputes

Any claim relating to the use of the Gift Card must be sent to: TAPE A L'OEIL – Service client - 24 Avenue du Grand Cottignies, 59290 WASQUEHAL, by registered letter with acknowledgement of receipt, or directly on the website at www.taokids.com via the contact form ( https://www.taokids.com/contact ).

Any dispute arising from the use of the Gift Card will be subject to French law and brought before the competent French courts.

CLAUSE 5 - SECURE PAYMENTS

TAO uses a secure payment service to ensure the secure nature of payments made. Bank data is encrypted (SSL security standard) and does not circulate in clear text on the Internet.

CLAUSE 6 - DELIVERY

6.1. Delivery terms

Products purchased by the Customer are delivered within a maximum of thirty (30) days from confirmation of the order to the address indicated by the Customer when ordering on the Website. Except in special cases or unavailability of one or more Products, the Products ordered will be delivered in a single delivery.

If delivery is not made within this period for any cause other than force majeure, the sale may be terminated at the Customer’s written request under the conditions provided for in Articles L 138-2 and L 138-3 of the French Consumer Code. The sums paid by the Client will then be returned to the Customer no later than fourteen days following the date of termination of the contract, to the exclusion of any compensation or withholding. TAO also offers free delivery to one of its stores, as listed on the Website, for a minimum order of €10. The Customer must check the condition of the delivered Products. The Customer has 14 days from delivery to file a claim via the contact form( https://www.taokids.com/contact ) regarding any reservations or claims for non-compliance or an apparent defect in the delivered Products, with all related supporting documents. After this period and failing compliance with these formalities, the Products shall be deemed compliant and free of any apparent defect and no claim may be validly accepted by TAO. TAO shall replace delivered Products whose apparent defects or non-compliance have been duly proven by the Customer as soon as possible and at its own expense, under the conditions provided for in Article L 211-4 of the French Consumer Code and those provided for in these General Terms and Conditions of Sale.
The delivery methods are as follows:

  • Delivery to a TAO store in Metropolitan France (excluding sales periods and subject to any change by TAO) (€3.50 - free for purchases totalling €10 or more):
    The Customer must go to the chosen store with the order summary email. The Customer has 10 calendar days from the arrival of the package to collect the package from the store. An email will notify the Customer of the availability of their package. Exceptionally, during periods of Private Sales and Sales, the Customer has 5 calendar days from the arrival of their web order to collect their parcel in the store.
  • Relay point delivery (€3.50 - free for purchases totalling €60 or more):
  • Delivery by post: €5.90 in mainland France.

Products purchased by the Customer may be delivered worldwide.

6.2. Tax refunds

6.2.1. In-store tax refund

Any customer not residing in the European Union may benefit from a tax refund upon request when paying in store. The store will issue a document drawn up by a certified tax refund body and will then provide the customer with two copies of a signed and stamped slip accompanied by pre-paid envelopes.

6.2.2. International web order tax refund

Any Customer not residing in the European Union and placing an order in their place of residence will not be subject to VAT. As such, VAT will appear at 0%.

Abroad, delivery costs borne by the Customer are subject to the rates in force on the website of La Poste.

CLAUSE 7 – RETENTION OF TITLE – TRANSFER OF RISKS

TAO retains full ownership of the Products until full payment of the price by the Customer, including principal, fees and taxes.
The risks of loss and damage to the Products are transferred when the Customer takes physical possession of the Products.

CLAUSE 8 - RETURNS AND EXCHANGES

ARTICLE 8.1. BASIS

RIGHT OF WITHDRAWAL
In accordance with the legal provisions in force, the Customer has fourteen (14) days from receipt of the Products to exercise their right of withdrawal from the purchase, without having to give any reasons or pay any penalty, and obtain an exchange or refund, provided that the Products are returned new and with their labels, in their original packaging, within fourteen (14) days following notification to TAO of the Customer’s decision to withdraw from the purchase.
If the right of withdrawal is exercised within the aforementioned period, only the price of the entire order for the Products purchased plus delivery costs will be refunded; the return costs shall be borne by the Customer if delivery by post was selected. The exchange (possible only in store - subject to availability) or refund will be made within fourteen (14) days of receipt by TAO of the Products returned by the Customer.

SATISFACTION GUARANTEE

Products ordered on the Website by a Customer with a valid loyalty card may be exchanged or refunded throughout the season, i.e. until the last day of the national sales for the season in question as from their purchase. The refund will be made as soon as possible. Only the price of the Product will be refunded to the Customer.

CLAUSE 8.2. CONDITIONS AND METHODS OF RETURN - WEB PURCHASES

The returned Product must be in its original and complete condition (packaging, labels, accessories, etc.) enabling it to be resold as new, accompanied by the purchase invoice and the mandatory order number. Damaged, dirty or incomplete Products will not be taken back.

  • Exchanges or refunds in TAO stores in Metropolitan France (free service)
    The refund will be made upon presentation of the invoice or upon presentation of the order summary email (which must include the order number).
  • By post: A Product may be returned by the customer to the following address:
    DC1 Geodis - Retour Web TAO - Parc des industries Artois-Flandres - 450 rue de Bruxelles 62138 DOUVRIN (return costs to be borne exclusively by the Customer)
  • The Customer may deposit the Product at a Mondial Relay point (free service) accompanied by the duly completed slip – without this information no refund is possible.

CLAUSE 8.3. CONDITIONS AND METHODS OF RETURN - STORE PURCHASE

The returned Product must be in its original and complete condition (packaging, labels, accessories, etc.) enabling it to be resold as new, accompanied by the purchase invoice and the mandatory order number. Damaged, dirty or incomplete Products will not be taken back.

CLAUSE 9 - PRODUCT CHARACTERISTICS

TAO AND TAO TWEENS PRODUCTS:

The information, characteristics, photographs and graphics presented on our website at www.taokids.com or in the Newsletters sent by TAO are presented as accurately as possible. Each Product sheet presents the basic characteristics of the Product selected in accordance with Article L.111-1 of the French Consumer Code. This information is intended to inform the Customer as fully as possible about the basic characteristics of the Products, without being exhaustive. The Customer is informed, subject to its rights, of the possibility of a difference in presentation on Delivery resulting from a change in packaging (photography and illustrations). This difference will not in any way affect the content and characteristics of the Product.

THIRD-PARTY BRAND PRODUCTS / PARTNER BRANDS (= Brands owned by Partners that we have selected to expand our product offering).

The information, characteristics, photographs and graphics presented on the website at www.taokids.com or in the newsletters sent by TAO are presented with the greatest possible accuracy. Each Product sheet is drafted based on information provided by the manufacturer or supplier of the Product and presents the basic characteristics of the Product selected in accordance with Article L.111-1 of the French Consumer Code. This information is intended to inform the Customer as fully as possible about the basic characteristics of the Products, without being exhaustive. The Customer is informed, subject to its rights, of the possibility of a difference in presentation on Delivery resulting from a change in packaging (photography and illustrations) by the manufacturer or the supplier. This difference will not in any way affect the content and characteristics of the Product.

CLAUSE 9 - LEGAL GUARANTEES

  • The Products supplied by TAO benefit from, in accordance with the legal provisions: the legal guarantee of conformity, for Products that are apparently defective, damaged or damaged or do not correspond to the order (articles L211-4 et seq. of the French Consumer Code). The Customer:
    - has a period of two years from delivery of the property to take action against the Seller;
    - may choose between having the ordered Product repaired or replaced, subject to the cost conditions provided for in Article L 217-9 of the French Consumer Code;
    - is exempt from providing proof of the existence of the lack of conformity of the Product during the six months following delivery of the Product. This period has been extended to 24 months since 18 March 2016, except for second-hand goods.
  • The legal guarantee of conformity applies independently of any commercial warranty that may apply to the Product.
  • the legal warranty against hidden defects resulting from a material, design or manufacturing defect affecting the delivered Products and making them unfit for use (Article 1641 et seq. of the French Civil Code). In this case, the Customer may choose between cancelling the sale or accepting a reduced sale price in accordance with Article 1644 of the French Civil Code.
  • In order to assert its rights, the Customer must inform TAO in writing of the existence of any hidden defects within a maximum of two years from their discovery. The corresponding returned Product must then be sent to TAPE A L’ŒIL – Service Qualité – 24 Avenue du Grand Cottignies, 59290 WASQUEHAL.

TAO will replace or refund Products under warranty that are found to be non-compliant or defective. The return costs will be compensated based on the rate invoiced in the form of a discount code for use on the www.taokids.com website. Refunds will be made as soon as possible and upon receipt of the item after acknowledgement by TAO of the non-compliance or hidden defect, by crediting the Customer's bank account used to pay for the order.
TAO may not be held liable in the following cases:

  • Non-compliance with the legislation of the country in which the Products are delivered, which the Customer is responsible for verifying,
  • In the event of misuse, use for professional purposes, negligence or lack of maintenance by the Customer, such as in the event of normal wear and tear of the product, accident or force majeure.
  • In any event, the TAO warranty is limited to the replacement or refund of non-compliant or defective Products.
  • The photographs and illustrations accompanying the Products on the Website have no contractual value and are therefore not binding on TAO.

FOR THIRD-PARTY BRAND/PARTNER BRAND PRODUCTS:

The Customer is expressly informed that TAPE A L’ŒIL SAS is not the manufacturer of the products presented in the context of the website https://www.taokids.com/marques-et-partenaires / selection of Partner Brand products, within the meaning of law no. 98-389 of 19 May 1998 relating to liability for defective products.

Consequently, in the event of damage caused to a person or property by a defective product, only the manufacturer of the product in question may be held liable by the Customer, based on the information contained on the packaging of said product. In addition, TAPE A L’ŒIL SAS recalls that the products, services and information offered by TAPE A L’ŒIL / PARTNER BRANDS should not under any circumstance replace constant vigilance by adults. TAPE A L’ŒIL SAS cannot be held liable in the event of non-compliance with the legislation of the country where the products are delivered. It is the Customer's responsibility to check with the local authorities that it is possible to import or use the products or services that they intend to order.

Nevertheless, the products offered comply with current French legislation and the standards applicable in France. TAPE A L’ŒIL SAS cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. TAPE A L’ŒIL SAS cannot be held liable for any inconvenience or damage relating to use of the Internet, such as an interruption of service, the presence of computer viruses or external intrusions and, more generally, any case qualified as force majeure or attributable to third parties according to the courts. Hyperlinks may link to websites other than the www.taokids.com website. TAPE A L’ŒIL SAS declines any liability in the event that the content of such websites contravenes the legal and regulatory provisions in force.

CLAUSE 10 - PERSONAL DATA

TAPE A L’OEIL is committed to protecting Customers’ personal data and ensuring the highest level of protection.

To deliver its service, TAPE A L’ŒIL collects personal data from Customers visiting its TAPE A L’ŒIL website as well as from Customers in stores.

TAPE A L’OEIL, as Data Controller, undertakes to comply with the provisions of Regulation (EU) No. 2016/679 of 27 April 2016 on the protection of personal data (the GDPR) and French law no. 78-17 of 6 January 1978, as amended (the French Data Protection Act).

CLAUSE 11 - INTELLECTUAL PROPERTY

All parts of the Website, whether or not registered under a trademark, are the exclusive property of TAO. All trademarks, photos, Product sheets, descriptions, layout, images, graphics, sounds, logos, etc. on the Website are protected in particular by copyright, trademark rights and image rights. Any total or partial reproduction of this content constitutes an infringement that may incur the civil and criminal liability of the perpetrator. Users who have a website or blog and who wish to place a simple link directly to the home page of the Website must request authorisation from TAO. Any hypertext link to the Website is strictly prohibited.

CLAUSE 12 - SEVERABILITY

In the event that one of the clauses of these general terms and conditions is rendered null and void by a change in the legislation or regulations or pursuant to a court decision, this will not affect the validity and compliance with the other clauses of these General Terms and Conditions of Sale.

CLAUSE 13 - PRE-CONTRACTUAL INFORMATION - CUSTOMER ACCEPTANCE

The Customer acknowledges having received these General Terms and Conditions of Sale and all the information referred to in Articles L 111-1 and L111-7 of the French Consumer Code prior to the conclusion of the contract, in a clear and understandable manner, and in particular:

  • the basic characteristics of the Product, taking into account the communication medium used and the Product in question,
  • the price of the Products and ancillary costs (for delivery, for example),
  • in the absence of immediate performance of the contract, the date or deadline by which TAO undertakes to deliver the Product,
  • information relating to the identity of TAO, its postal, telephone and electronic contact details, and its business, if this is not clear from the context,
  • information relating to the legal and contractual warranties and their implementation procedures,
  • the functionalities of digital content and, where applicable, its interoperability,
  • the possibility of recourse to conventional mediation in the event of a dispute,
  • information relating to the right of withdrawal (existence, condition, period, procedures for exercising this right and standard form for withdrawal), the cost of returning the Products, the termination procedures and other important contractual conditions.

CLAUSE 14 – GOVERNING LAW – LANGUAGE – DISPUTES

By express agreement between the parties, this contract is governed by and subject to French law. It is written in French. If it is translated into one or more languages, only the French text shall prevail in the event of a dispute.
Any disputes to which the purchase and sale transactions concluded pursuant to these General Terms and Conditions of Sale may give rise, concerning their validity, interpretation, performance, termination, consequences and repercussions, and which cannot be resolved between the seller and the Customer shall be submitted to the competent courts under the conditions of ordinary law.
In the event of a dispute, in accordance with Article L 612-1 et seq. of the French Consumer Code, the Customer may refer any claim relating to a purchase of a product on the Website submitted during the last twelve (12) months to a mediator approved by the Mediation Evaluation and Control Commission free of charge.

CLAUSE 15 - GENERAL TERMS AND CONDITIONS OF USE OF THE My TAO Community CARD

These general terms and conditions of membership of the TAPE A L’ŒIL loyalty programme through purchase of the loyalty card (hereinafter the “My TAO Community card”) are entered into between, on the one hand:

TAPE A L’ŒIL, a French simplified joint stock company (société par actions simplifiée) with variable capital, whose registered office is at 24 Avenue du Grand Cottignies, Wasquehal (59290), registered in the Lille Metropole Trade and Companies Register under number 389.632.639. Hereinafter referred to as “TAPE A L’OEIL”

And on the other hand,

Any natural person wishing to join the TAPE A L’OEIL loyalty programme or use their My TAO Community card in a TAPE A L’OEIL store or on the www.taokids.com website.

Hereinafter referred to as the “Beneficiary”

Acceptance of the general terms and conditions of use of the My TAO Community card
The Beneficiary acknowledges having read and accepted these general terms and conditions; available in stores or on the www.taokids.com website.

TAPE A L’OEIL reserves the right to change, suspend or delete the general terms and conditions of use of its loyalty programme at any time.

Membership of the TAPE A L’ŒIL My TAO Community loyalty programme
The My TAO Community card can be purchased in all TAPE A L’OEIL stores in mainland France and Belgium and on the www.taokids.com website.

Its price is three (3) euros per year. This price may change.

The My TAO Community card is a paperless card. No physical shipment will be made when the card is purchased or renewed.

TAPE A L’ŒIL reserves the right to ask the beneficiary for any supporting document for the information provided (in particular personal information, identity of the children, date of birth of the children, etc.)

Validity
The My TAO Community card is valid in TAPE A L’ŒIL stores and on the www.taokids.com website for one year from the date of purchase.

The My TAO Community card is strictly personal (a person may only hold one card) and may not under any circumstances be sold or used for purposes other than those defined in these general terms and conditions. Otherwise, TAPE A L’ŒIL reserves the right to delete the loyalty card concerned and/or the order(s) concerned.

My TAO Community card benefits
Loyalty points:
Upon presentation of the My TAO Community card in store or simply by indicating the name of the Beneficiary, and on the Internet, each purchase earns points attributed at the time of purchase, at the rate of 1 point per full tranche of 10 euros of purchase. Where items are refunded, the points earned for these products are deducted from the Customer's loyalty account.

When the 15-point threshold is reached, a loyalty cheque for a value of 10 euros is credited to the Cardholder's account. The excess points earned are added to subsequent purchases.

This loyalty check is valid for two (2) months from its issue date and is not exchangeable or refundable. It may be used by the Beneficiary in stores or on the www.taokids.com website to pay for purchases.

Children’s birthdays:
From the 1st to the 15th birthday of the Beneficiary's child(ren)/grandchild(ren)
For the birthday of the Beneficiary's child(ren) and/or grandchild(ren), the card entitles the Beneficiary to a birthday voucher worth 5 euros for the parents or tribe profile, and -30% on the preferred item for the grandparents given or sent to the card Beneficiary.The birthday voucher can be used only once, in store, on www.t-a-o.com or on www.t-a-o.be, valid between 30 days before and 15 days after the child's registered birthday. Birthday vouchers are neither exchangeable nor refundable.

Exchanges valid throughout the season:
Products purchased or ordered on the www.taokids.com website by a customer with a valid My TAO Community loyalty card may be exchanged or refunded (only the price of the Product will be refunded to the Customer) throughout the season, i.e. until the last day of the national sales for the season in question as from their purchase.

Renewal
The Beneficiary is notified by TAPE A L’ŒIL by email or SMS of the possibility of renewing their card thirty (30) days before its expiry date and then on the expiry date itself. The points earned with the card are retained during its validity period and for one year from its expiry date, so that a renewal made during this period does not result in any loss of points. The fee is three euros. This price may change. Renewal does not result in the sending of a new card.

Personal data
TAPE A L’OEIL collects personal data concerning the Beneficiary in the context of their subscription to the My TAO Community loyalty programme. This information is processed electronically to enable TAPE A L’OEIL to process the Beneficiary’s requests, allow them to benefit from the loyalty programme and send them TAPE A L’OEIL offers. The recipient of this data is TAPE A L’OEIL.

Card withdrawal Card withdrawal Any breach of these General Terms and Conditions, any misuse or fraudulent use of the benefits offered by the My TAO Community card, any behaviour detrimental to the interests of TAPE A L’ŒIL, any falsification of the information sent by a Customer or by a third party acting on behalf of a Customer, shall automatically result in said Customer’s removal from the loyalty programme and the cancellation of their points or the benefits they have obtained, without compensation of any kind and without prior notice.
TAO reserves the right to take any action it deems appropriate in the event of an erroneous or false declaration made upon subscribing to the My TAO Community card loyalty programme and/or misuse or fraudulent use of said programme.

APPENDIX I

Provisions relating to legal guarantees

Article L217-5 of the French Consumer Code
To be in conformity with the contract, the property must:

  • Be fit for the use usually expected of similar property and, where applicable:
  • correspond to the description given by the seller and possess the qualities that the latter has presented to the purchaser in the form of a sample or model
  • present the qualities that a purchaser may legitimately expect with regard to public declarations made by the seller, by the manufacturer or by its representative, in particular in the form of advertising or labelling
  • Or present the characteristics defined by mutual agreement between the parties or be fit for any special use sought by the purchaser, made known to the seller and accepted by the latter.

Article L217-12 of the French Consumer Code
Any action resulting from non-compliance is time-barred two years from delivery of the property.

Article L217-16 of the French Consumer Code
When the purchaser asks the seller, during the course of the commercial warranty granted to it at the time of the acquisition or repair of movable property, for a repair covered by the warranty, any period of immobilisation of at least seven days is added to the remaining duration of the warranty. This period runs from the request for intervention by the purchaser or the provision for repair of the property in question, if this provision is subsequent to the request for intervention.

Article 1641 of the French Civil Code
The seller is bound by the warranty on account of hidden defects in the item sold which render it unfit for its intended purpose or which diminish this use such that the purchaser would not have acquired it, or would only have paid a lower price for it, if the purchaser had known of such defects.

Article 1648 paragraph 1 of the French Civil Code
Any action resulting from critical flaws must be brought by the purchaser within two years of the discovery of the defect.
